Client Content & Intellectual Property Policy

This policy explains ownership, permissions, acceptable source content, final-file rights, portfolio use, and restrictions relating to photographs and image materials submitted for editing.
1. Client ownership of source content
The client retains whatever copyright, privacy, publicity, trademark, contractual, or other rights the client lawfully holds in the source photographs and materials. Submission of files does not transfer ownership of those underlying rights to Pixelnest Photo.
2. Client authority and warranties
By submitting a file, the client confirms that the client owns it or has sufficient permission from the relevant owner, photographer, agency, employer, subject, licensor, or other rights holder to provide it for the requested editing and intended use.
The client also confirms that the requested work and planned use do not violate copyright, trademark, publicity, privacy, confidentiality, contract, court order, platform rule, or applicable law.
3. Limited project permission
The client grants Pixelnest Photo a limited, nonexclusive, revocable permission to receive, copy, store, inspect, process, edit, export, organize, and transmit the submitted materials solely as reasonably necessary to perform the project, communicate about it, maintain administrative records, protect system security, and comply with applicable obligations.
This permission does not authorize unrelated public distribution, resale, stock licensing, merchandising, advertising, or publication.
4. Subjects and personal rights
The client is responsible for obtaining any consent required from people depicted in the photographs, including consent related to privacy, publicity, employment, commercial advertising, minors, private locations, or sensitive contexts. Editing a photograph does not create or replace a model release, property release, location permission, or other required authorization.
5. Restricted and prohibited content
We may refuse files or instructions that appear to involve:
- content provided without adequate ownership or permission;
- forged identification, financial, legal, educational, medical, or government records;
- non-consensual intimate imagery or sexual exploitation;
- deceptive impersonation, fraud, harassment, or defamation;
- material intended to create a false record of an event or transaction;
- unlawful surveillance, threats, or abuse;
- content that creates a material safety, legal, or ethical concern.
Refusal to perform a request does not constitute a legal determination about the underlying content.
6. Editing does not transfer third-party rights
Payment for editing does not purchase copyright in a photograph owned by another person. It does not expand the client's license from a photographer, stock provider, agency, employer, publisher, or platform. The client remains responsible for understanding and following the terms attached to the source image.
7. Rights in final edited files
After full payment, the client may use the delivered final files for the purposes permitted by the rights the client already holds in the source content and any written project agreement. The editing service does not restrict the client's lawful use of the final export solely because Pixelnest Photo performed the adjustments.
Any rights in the source photograph remain subject to the original owner, license, releases, and applicable law. If the project includes separately created graphic elements, templates, licensed assets, or third-party materials, their use may remain subject to additional terms disclosed for the project.
8. Internal methods and working files
Editing methods, workflows, presets, masks, adjustment structures, process knowledge, reusable templates, application catalogs, and internal working files remain the property of Pixelnest Photo or the relevant software or asset owner. Unless expressly included in writing, the client receives the final exported deliverables rather than internal process files.
9. Portfolio and promotional use
Client photographs are not used in a public portfolio, social post, advertisement, case study, before-and-after comparison, training material, or promotional presentation without separate permission. Permission must identify the approved file or project and may include conditions concerning attribution, timing, crop, or context.
A client's decision not to grant promotional permission does not affect the performance of the paid editing service.
10. Artificial intelligence and automated tools
Routine editing software may contain automated features that assist with selections, noise reduction, masking, color correction, or export. Client files will not be intentionally submitted for unrelated public model training or used to build a separate commercial dataset without express permission.
If a requested project would benefit from a materially generative process that changes the nature of the original image, the scope should identify that approach before it is used.
11. Metadata
Editing and export may preserve, modify, or remove metadata depending on software settings, privacy considerations, file format, platform processing, and the agreed output. Clients who require preservation of specific copyright, camera, caption, location, or rights metadata must identify that requirement before work begins.
12. Claims and takedown requests
A person who believes submitted or displayed content infringes their rights should provide enough information to identify the material, explain the claimed right, identify the project or page where possible, and provide reliable contact details. We may request verification and may restrict access to content while a good-faith claim is reviewed.
Submitting a false rights claim may create legal consequences. This process is not a substitute for professional legal advice.
13. Confidential materials
If source files are confidential, embargoed, commercially sensitive, or subject to a separate nondisclosure obligation, the client should disclose that status before transfer and request written confidentiality terms where necessary. Pixelnest Photo cannot accept undisclosed contractual duties owed by the client to another party.
14. Client responsibility after delivery
The client determines how and where final files are published, printed, distributed, or archived. The client is responsible for final captions, factual claims, releases, licenses, accessibility descriptions, disclosures, advertising compliance, and platform requirements associated with that use.
15. Policy changes
This policy may be updated prospectively to reflect changes in services, software, rights-management practices, or applicable law. Project-specific written rights terms remain controlling for the project to the extent they directly differ from this general policy.
